Two men, 49-year old Hiroshi Nagata and 36-year old Shu Ishitobi, have been arrested by Japan's Ibaraki Prefectural Police. They were charged with molestation and attempted rape. The victim was a 12-year old girl who made use of one of her Nintendo 3DS's features after presumably disabling set parental controls to contact the men through the internet. She subsequently met with them alone in a hotel room on at least two occasions in January and February. Rape was suspected at first, but not charged officially.

It was not specifically indicated whether Swapnote's SpotPass service was directly involved, although as we all know, that and Flipnote Gallery: Friends (image sharing) were both recently terminated. However, it was confirmed in a separate incident that a different Japanese man was charged with child pornography for having two children send him nude photos on Swapnote. There are other claims of predators using the Nintendo 3DS online; so far these are the only charges/arrests. Statistics can't be correlated well to this even while Japan does tend to have frequencies of sexual predators and sex crimes. It would only have been a matter of time before similar incidents start[ed] happening in more populated countries like the US, so it is possible to see the 3DS's restrictions strengthened further.

That and likely other cases are probably why the features were disabled.

For what it's worth, I'm perfectly willing to sacrifice a game feature if it means one or two safer children.

Ibaraki Prefecture is about the size of Delaware, a very small state. Spotted with small cities. Its capital city is physically comparable to Cleveland or Oakland, but much less developed. Add in the probability of 10-40 hotels in any given urban area, and one is nearly always within minutes' walking distance. It is very likely the child lived in the city where many Japanese people own 3DSes, and walked no more than a few blocks.

This kind of incident really makes me hope Pokemon Go will not be used by criminals to lure victims to Pokestops or Gyms. Maybe the game's volume of players prevents it (in these early months).

Believe it or not, it's already happening, some people got arrested for this not so long ago hue.
